Terms of Service
Draft — pending legal review. This document was written by the engineering team so that counsel can check it against the law and against how Passport actually works. It is not legal advice, it is not final, and every value in square brackets still has to be filled in before launch.

1. What Passport is
Passport is a personal travel diary: you log the places you have been, plan to visit or dream of, and the app draws them on a globe. It can be used in two ways — entirely in your browser on one device, or with an account that privately syncs your diary between your devices.
Passport is a private tool. It has no public profiles, no feeds, no likes, no comments and no publishing features, and we do not plan to add them.
By creating an account or using the app you agree to these Terms and to our Privacy Policy.
2. Personal use
Passport is for your own personal, non-commercial use: your travels, your notes, your photos. You may not resell access, offer it as a service to others, or use it to store someone else's records on their behalf.
3. Your account
You need a working email address to create an account, and you must be at least [MINIMUM_AGE] years old. Keep your password to yourself, use a password you have not reused elsewhere, and tell us at [SUPPORT_EMAIL] if you think someone else has access to your account.
You are responsible for what happens under your account. We may ask you to confirm your password before sensitive actions such as changing your email or deleting your account.
4. Your content
Your entries, notes, place snapshots and photos are yours. We claim no ownership of them.
You grant us only the permission we need to run the service for you: to store your content, to transmit it between your devices, to create the resized copies and thumbnails the app displays, and to back it up. That permission exists so the product can work, ends when you delete the content or your account, and is not a licence to publish, sell or analyse your diary.
You confirm that you have the right to store the content you upload, including any photos of other people, and that it does not infringe anyone's rights or break the law.
5. Acceptable use
Do not use Passport to:
- store or distribute unlawful content, including child sexual abuse material or content that infringes someone else's rights;
- store content that violates another person's privacy, such as material obtained without consent;
- attack the service — probing, scanning, denial-of-service, circumventing the account limits or row-level security, or attempting to reach another account's data;
- automate the service at a scale that degrades it for other people, or resell its capacity;
- work around the per-account limits that keep the service running fairly.
Those limits cover how many entries and photos an account may hold and how much storage it may use; the app shows your account's use against them. They exist to keep a free, private service affordable, and we may adjust them with notice.
6. Availability and changes to the service
Passport is provided as it is, and we may change, add or withdraw features. If we plan to withdraw something you depend on, we will tell you in the app or by email first, and — for anything that affects stored data — leave you time to export it.
There is no subscription, no billing and no paid tier. We do not sell your data, and we do not run advertising.
7. No warranty
Passport is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error free, or that it will preserve your data.
Keep your own backups. Settings → Backup exports everything as a .travelog file. Do that regularly; it is the only copy that is entirely under your control.
[Counsel: consumer law in some jurisdictions makes parts of this section unenforceable — please add the required carve-out for statutory consumer guarantees.]
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data or the cost of substitute services, arising out of or related to your use of Passport.
To the fullest extent permitted by law, our total liability arising out of or related to these Terms is limited to [LIABILITY_CAP].
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud.
[Counsel: confirm the cap and the mandatory carve-outs for the jurisdictions we serve.]
9. Ending it
You may stop using Passport at any time, and you can delete your account yourself in Account → Danger zone → Delete account. Deletion removes your database rows, your photo files and your sign-in, as described in the Privacy Policy.
We may suspend or end an account that breaks these Terms, that is used to attack or abuse the service, or where the law requires it. Except where that is impossible (for example, because the content is unlawful), we will tell you why and give you a chance to export your data first.
10. Changes to these Terms
When these Terms change we will update the version identifier at the top and show the new version in the app. For material changes we will ask you to accept them, or tell you by email before they take effect. The version you accepted is recorded with your account. If you do not accept a change, you can export your data and delete your account.
11. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION], and the courts of [JURISDICTION] have jurisdiction over disputes arising from them, without depriving you of the protection of any mandatory consumer law of the country where you live.
[Counsel: add the dispute-resolution, venue and (where applicable) arbitration and class-action wording, and check the consumer carve-out above.]
